(“Facebook”), X, INC (“X”), INSTAGRAM, INC. (“Instagram”), OR YOUTUBE, LLC (“YouTube”).
1.    ELIGIBILITY:
The Kunes America 250 Giveaway (the “Promotion”) is open to legal U.S. residents who are at least 18 years old. Kunes Country Automotive Management, Inc. (“Sponsor”), its parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising firms, public relations firms, vendors, OEMs, and marketing agencies, website providers and each of their employees, officers, and directors (collectively, the “Promotion Entities”), and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Participation constitutes participant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Promotion and which Sponsor may decide in its sole discretion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2.    SPONSOR:

3.    HOW TO ENTER:
During the Promotion Period you can register at Kunes Ford of Delavan, Kunes Chevrolet Cadillac of Delavan, Kunes Ford of Antioch, Kunes CDJR of Elkhorn, Kunes Chevrolet GMC of Elkhorn, and Kunes Chevrolet Buick GMC of Lake Geneva. In addition, you can also register online for each location as well. Registration will include name, valid address, phone, proof of age over 18, and email, as well as the participating dealership location. Upon completion and submission of this information at the Promotion kiosk located at each participating dealership, you automatically will be entered with ten (10) entries into the Promotion. Those registering online at the dealership’s website will receive one (1) extra entry into the Promotion. Those individuals entering both at the dealership and online at the dealership’s website will receive a total of eleven (11, 10+1) entries into the Promotion for each participating location. You must provide all required information to be eligible to enter and win. By entering, you agree that Sponsor may contact you via social media, including on Facebook, Instagram, and X, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media page. Consent to receive SMS/text message communications from Sponsor is not required to enter or win this Promotion. Phone numbers collected may be used to contact participant’s regarding the Promotion and, if separately consented to, for marketing.
Except where prohibited by law, participation in the Promotion constitutes participant’s grant to sponsor (which grant will be confirmed in writing on request of sponsor, and the released parties the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the participant’s entry, name, portrait, picture, voice, likeness, opinions and biographical information (including but not limited to hometown and state) for advertising, trade, and promotional purposes (including the announcement of their name on television or radio broadcast) without additional consideration, compensation, permission, or notification.
Please note: By entering in this Promotion, you signify and agree that your entry and any other materials submitted in connection with this Promotion may be posted on Sponsor’s website and/or other social media sites or applications associated with the Promotion in a manner that is consistent with these Official Rules. You must provide all required information to be eligible to enter and win. The winner is subject to verification before any prize is awarded.
THERE IS A LIMIT OF SIXTY-SIX (66) TOTAL POSSIBLE ENTRIES PER PERSON FOR THIS PROMOTION. TEN (10) ENTRIES AT EACH OF THE SIX (6) PARTICIPATING DEALERSHIPS AND ONE (1) EXTRA ENTRY MADE ONLINE AT EACH OF THE SIX (6) PARTICIPATING DEALERSHIP’S WEBSITES. ALL ELIGIBLE ENTRIES FROM ALL PARTICIPATING DEALERSHIP LOCATIONS, INCLUDING THE ONLINE ENTRIES, WILL BE COMBINED INTO A SINGLE POOL. THE ONE (1) WINNING ENTRY WILL BE DRAWN FROM THE COMBINED POOL. THE PRIZE WILL BE ASSIGNED BASED ON THE PARTICIPATING DEALERSHIP’S SPECIFIED VEHICLE PRIZE ASSIGNED TO THE WINNING PROMOTION ENTRY. ADDITIONAL ENTRIES MAY BE DISQUALIFIED, automated or bulk entries or entries submitted by third parties may be disqualified. Entries must only be submitted via online at the participating dealership’s website or at the Promotion kiosk at each of the participating dealerships. No copies, facsimiles, or mechanical reproductions of the entry form will be accepted.
4.    SELECTION OF WINNERS:
On Wednesday, September 3, 2026, Sponsor will select the name of the one (1) winner in a random drawing from the single combined pool of all eligible entries received from all participating locations, including all dealership kiosks and via online at the participating dealership’s website. The Winner will be drawn from among all eligible entries in the pool. A Winner may have registered at any participating location. The odds of winning depend on the total number of eligible entries received across all participating locations combined. We will attempt to notify the Winner by email and telephone, on Friday, September 4, 2026. We will continue to attempt to contact the Winner for seven (7) business days and will thoroughly document those notification attempts. If the Winner is still unable to be contacted and is unresponsive, then another winner will be drawn from the remaining pool of entries.
Except where legally prohibited, the Winner must schedule delivery of the prize, within seven (7) days of acknowledgement of the notification, and submit a Declaration of Eligibility and Publicity Release to claim their prize. If the Winner fails to sign and return the Declaration of Eligibility and Publicity Release or any other documentation that Sponsor may require, in its sole discretion, within the required time period (if applicable), if Winner fails to schedule delivery of the prize within the time period specified by Sponsor, or in the event that a Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate Winner selected by a random drawing from among all remaining eligible entries and subject to the same requirements set forth above. If Sponsor are unable to determine and verify a Winner after repeated alternate drawings, Sponsor reserves the right not to award the prize.
Verification of the Winners: THE WINNERS ARE SUBJECT TO VERIFICATION BY THE SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL PARTICIPANT’S ELIGIBILITY HAS BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETED BY SPONSOR.
5.    PRIZES:
There will be one (1) prize awarded for the Promotion selected from a single combined pool of all eligible entries. Winner will be drawn from the combined pool without regard to which location the entrant registered at. Prize will be assigned based on the participating dealership that was assigned to the winning Promotion entry. An entrant who registered at any participating location is eligible to win the prize assigned to that specific entry location.

PRIZE RESTRICTIONS: Winner will be responsible for payment of associated federal, state, and local taxes on the Verifiable Retail Value of the vehicle at the time of title transfer, plus DMV title, E-File, and license fees. Illinois winners may also be responsible for a 4.95% flat income tax on the Verifiable Retail Value of the vehicle. Sponsor will issue the Winner a 1099 tax form recording the receipt of their prize in the amount of the Verifiable Retail Value stated herein. Any and all fees and expenses related to acceptance and use of the prize not specifically stated herein, including but not limited to automobile insurance and any other costs associated with vehicle ownership, are the sole responsibility of the winner. Prizes do not include any transportation to and from the Dealership. The prize cannot be substituted, assigned, transferred, or redeemed for cash. The sponsor will not replace any lost or stolen prizes. No insurance is provided as part of the prizes, and obtaining insurance is the sole responsibility of the Winners. The prizes cannot be used in conjunction with any other promotion or offer. Only one prize stated in these Official Rules is available to be won in the Promotion. Other terms, restrictions, conditions and limitations may apply.
6.    GENERAL CONDITIONS:
Participation constitutes Participant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Promotion Entities and their affiliates are not responsible for lost, late, or incomplete entries; technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise, the announcement of the prize or in any Promotion-related materials.
WARNING: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any website associated with the Promotion, and/or the legitimate operation of the Promotion; to violate the Official Rules.
Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor. If, for any reason, the Promotion cannot be run as planned, Sponsor may disqualify any suspect entries and (a) suspend the Promotion and/or modify the Promotion to address the impairment, then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (b) terminate the Promotion and award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.
7.    LIMITATION OF LIABILITY AND RELEASES; PUBLICITY:

8.    DISPUTES:
Except where prohibited, participant agrees that: (1) all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State of Wisconsin court system located in Walworth County, Wisconsin, or the United States District Court for the Eastern District of Wisconsin (Milwaukee Division); (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion not to exceed fifty US Dollars (US$50.00), but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Promotion Entities may use participants’ and/or referrals’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor thinks may be of interest.

HOW TO ENTER: During the Contest Period you can register at Kunes Greenfield Buick GMC, Kunes Oak Creek Buick GMC, and Kunes Chevrolet Milwaukee.  In addition, you can also register during Summerfest Milwaukee from June 18-20, June 25-27, and July 2-4, 2026.   Registration will include name, valid address, phone, proof of age over 18, and email, as well as store location.  Upon completion and submission of this information at the Contest kiosk located at each participating dealership, you automatically will be entered with ten (10) entries into the Contest.  Those registering at Summerfest Milwaukee will receive one (1) entry into the Contest. The Summerfest Milwaukee submission will be completed using the QR code on each display vehicle.  Those individuals entering both at the dealership and at Summerfest Milwaukee will receive a total of thirty one (31, 10+10+10+1) entries into the Contest.  You must provide all required information to be eligible to enter and win.  By entering, you agree that Sponsor may contact you via social media, including on Facebook, Instagram, and X, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media page.  Consent to receive SMS/text message communications from Sponsor is not required to enter or win this Contest.

SELECTION OF WINNERS: On Wednesday, September 3, 2026, Sponsor will select the names of the three (3) prize winners in a random drawing from the single combined pool of all eligible entries received from all participating locations, including all dealership kiosks and Summerfest Milwaukee (collectively, “Winners”).  Winners will be drawn sequentially; each subsequent drawing will be conducted from among all remaining eligible entries in the pool.  A Winner may have registered at any participating location.  The odds of winning depend on the total number of eligible entries received across all participating locations combined.  Each of the three drawings is conducted from the remaining entries in the single combined pool after the prior winner has been removed.  The winner will be notified by email and telephone, on Friday, September 4, 2026.   
Except where legally prohibited, a Winner must schedule delivery of the prize, within seven (7) days of being notified, and submit a Declaration of Eligibility and Publicity Release to claim their prize.  If the Winner cannot be contacted in person via email or telephone after the first attempt to contact them, or if they fail to sign and return the Declaration of Eligibility and Publicity Release or any other documentation that Sponsor may require, in its sole discretion, within the required time period (if applicable), if Winner fails to schedule delivery of the prize within the time period specified by Sponsor, or in the event that a Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate Winner selected by a random drawing from among all remaining eligible entries and subject to the same requirements set forth above. PRIZE RESTRICTIONS: Winner will be responsible for payment of associated federal, state, and local taxes, including Wisconsin sales and use tax assessed on the Verifiable Retail Value of the vehicle at the time of title transfer, plus DMV title and license fees.  Sponsor will issue each Winner a 1099 tax form recording the receipt of their prize in the amount of the Verifiable Retail Value stated herein.  Any and all fees and expenses related to acceptance and use of the prize not specifically stated herein, including but not limited to automobile insurance and any other costs associated with vehicle ownership, are the sole responsibility of the winner.  
Prizes do not include any transportation to and from the Dealership. The prize cannot be substituted, assigned, transferred, or redeemed for cash. 4.    SELECTION OF WINNERS:
On Wednesday, September 3, 2026, Sponsor will select the name of the one (1) winner in a random drawing from the single combined pool of all eligible entries received from all participating locations, including all dealership kiosks and via online at the participating dealership’s website. The Winner will be drawn from among all eligible entries in the pool. A Winner may have registered at any participating location. The odds of winning depend on the total number of eligible entries received across all participating locations combined. We will attempt to notify the Winner by email and telephone, on Friday, September 4, 2026. We will continue to attempt to contact the Winner for seven (7) business days and will thoroughly document those notification attempts. If the Winner is still unable to be contacted and is unresponsive, then another winner will be drawn from the remaining pool of entries.
Except where legally prohibited, the Winner must schedule delivery of the prize, within seven (7) days of acknowledgement of the notification, and submit a Declaration of Eligibility and Publicity Release to claim their prize. Upon completion and submission of this information at the Promotion kiosk located at each participating dealership, you automatically will be entered with ten (10) entries into the Promotion. Those registering online at the dealership’s website will receive one (1) extra entry into the Promotion. Those individuals entering both at the dealership and online at the dealership’s website will receive a total of eleven (11, 10+1) entries into the Promotion for each participating location. You must provide all required information to be eligible to enter and win. By entering, you agree that Sponsor may contact you via social media, including on Facebook, Instagram, and X, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media page. 4.    SELECTION OF WINNERS:
On Wednesday, September 3, 2026, Sponsor will select the name of the one (1) winner in a random drawing from the single combined pool of all eligible entries received from all participating locations, including all dealership kiosks and via online at the participating dealership’s website. The Winner will be drawn from among all eligible entries in the pool. A Winner may have registered at any participating location. The odds of winning depend on the total number of eligible entries received across all participating locations combined. We will attempt to notify the Winner by email and telephone, on Friday, September 4, 2026. We will continue to attempt to contact the Winner for seven (7) business days and will thoroughly document those notification attempts. If the Winner is still unable to be contacted and is unresponsive, then another winner will be drawn from the remaining pool of entries.
Except where legally prohibited, the Winner must schedule delivery of the prize, within seven (7) days of acknowledgement of the notification, and submit a Declaration of Eligibility and Publicity Release to claim their prize. If the Winner fails to sign and return the Declaration of Eligibility and Publicity Release or any other documentation that Sponsor may require, in its sole discretion, within the required time period (if applicable), if Winner fails to schedule delivery of the prize within the time period specified by Sponsor, or in the event that a Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate Winner selected by a random drawing from among all remaining eligible entries and subject to the same requirements set forth above. 8.    DISPUTES:

Upon completion and submission of this information at the Promotion kiosk located at each participating dealership, you automatically will be entered with ten (10) entries into the Promotion. Those registering online at the dealership’s website will receive one (1) extra entry into the Promotion. Those individuals entering both at the dealership and online at the dealership’s website will receive a total of eleven (11, 10+1) entries into the Promotion for each participating location. You must provide all required information to be eligible to enter and win. By entering, you agree that Sponsor may contact you via social media, including on Facebook, Instagram, and X, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media page. Consent to receive SMS/text message communications from Sponsor is not required to enter or win this Promotion. 4.    SELECTION OF WINNERS:
On Wednesday, September 3, 2026, Sponsor will select the name of the one (1) winner in a random drawing from the single combined pool of all eligible entries received from all participating locations, including all dealership kiosks and via online at the participating dealership’s website. The Winner will be drawn from among all eligible entries in the pool. A Winner may have registered at any participating location. The odds of winning depend on the total number of eligible entries received across all participating locations combined. We will attempt to notify the Winner by email and telephone, on Friday, September 4, 2026. We will continue to attempt to contact the Winner for seven (7) business days and will thoroughly document those notification attempts. If the Winner is still unable to be contacted and is unresponsive, then another winner will be drawn from the remaining pool of entries.
Except where legally prohibited, the Winner must schedule delivery of the prize, within seven (7) days of acknowledgement of the notification, and submit a Declaration of Eligibility and Publicity Release to claim their prize. If the Winner fails to sign and return the Declaration of Eligibility and Publicity Release or any other documentation that Sponsor may require, in its sole discretion, within the required time period (if applicable), if Winner fails to schedule delivery of the prize within the time period specified by Sponsor, or in the event that a Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate Winner selected by a random drawing from among all remaining eligible entries and subject to the same requirements set forth above. PRIZE RESTRICTIONS: Winner will be responsible for payment of associated federal, state, and local taxes on the Verifiable Retail Value of the vehicle at the time of title transfer, plus DMV title, E-File, and license fees. During the Promotion Period you can register at Kunes Auto Group of Macomb, Kunes Honda of Quincy, and Kunes Hyundai of Quincy. In addition, you can also register online for each location as well. Registration will include name, valid address, phone, proof of age over 18, and email, as well as the participating dealership location. Upon completion and submission of this information at the Promotion kiosk located at each participating dealership, you automatically will be entered with ten (10) entries into the Promotion. Those registering online at the dealership’s website will receive one (1) extra entry into the Promotion. Those individuals entering both at the dealership and online at the dealership’s website will receive a total of eleven (11, 10+1) entries into the Promotion for each participating location. You must provide all required information to be eligible to enter and win. By entering, you agree that Sponsor may contact you via social media, including on Facebook, Instagram, and X, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media page. Consent to receive SMS/text message communications from Sponsor is not required to enter or win this Promotion. Phone numbers collected may be used to contact participant’s regarding the Promotion and, if separately consented to, for marketing.

4.    SELECTION OF WINNERS:
On Wednesday, September 3, 2026, Sponsor will select the name of the one (1) winner in a random drawing from the single combined pool of all eligible entries received from all participating locations, including all dealership kiosks and via online at the participating dealership’s website. The Winner will be drawn from among all eligible entries in the pool. A Winner may have registered at any participating location. The odds of winning depend on the total number of eligible entries received across all participating locations combined. We will attempt to notify the Winner by email and telephone, on Friday, September 4, 2026. We will continue to attempt to contact the Winner for seven (7) business days and will thoroughly document those notification attempts. If the Winner is still unable to be contacted and is unresponsive, then another winner will be drawn from the remaining pool of entries.
Except where legally prohibited, the Winner must schedule delivery of the prize, within seven (7) days of acknowledgement of the notification, and submit a Declaration of Eligibility and Publicity Release to claim their prize. If the Winner fails to sign and return the Declaration of Eligibility and Publicity Release or any other documentation that Sponsor may require, in its sole discretion, within the required time period (if applicable), if Winner fails to schedule delivery of the prize within the time period specified by Sponsor, or in the event that a Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate Winner selected by a random drawing from among all remaining eligible entries and subject to the same requirements set forth above. PRIZE RESTRICTIONS: Winner will be responsible for payment of associated federal, state, and local taxes on the Verifiable Retail Value of the vehicle at the time of title transfer, plus DMV title, E-File, and license fees. Illinois winners may also be responsible for a 4.95% flat income tax on the Verifiable Retail Value of the vehicle. Sponsor will issue the Winner a 1099 tax form recording the receipt of their prize in the amount of the Verifiable Retail Value stated herein. Any and all fees and expenses related to acceptance and use of the prize not specifically stated herein, including but not limited to automobile insurance and any other costs associated with vehicle ownership, are the sole responsibility of the winner. The Kunes America 250 Giveaway (the “Promotion”) is open to legal U.S. residents who are at least 18 years old. Kunes Country Automotive Management, Inc. (“Sponsor”), its parents, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising firms, public relations firms, vendors, OEMs, and marketing agencies, website providers and each of their employees, officers, and directors (collectively, the “Promotion Entities”), and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Participation requires participant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Promotion and which Sponsor may decide in its sole discretion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3.    HOW TO ENTER:
During the Promotion Period you can register at Kunes Ford of East Moline, Kunes Toyota of Galesburg, and Kunes Nissan or Davenport. In addition, you can also register online for each location as well. Registration will include name, valid address, phone, proof of age over 18, and email, as well as the participating dealership location. Upon completion and submission of this information at the Promotion kiosk located at each participating dealership, you automatically will be entered with ten (10) entries into the Promotion. Those registering online at the dealership’s website will receive one (1) extra entry into the Promotion. Those individuals entering both at the dealership and online at the dealership’s website will receive a total of eleven (11, 10+1) entries into the Promotion for each participating location. You must provide all required information to be eligible to enter and win. By entering, you agree that Sponsor may contact you via social media, including on Facebook, Instagram, and X, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media page. Consent to receive SMS/text message communications from Sponsor is not required to enter or win this Promotion. Phone numbers collected may be used to contact participant’s regarding the Promotion and, if separately consented to, for marketing.
Except where prohibited by law, participation in the Promotion constitutes participant’s grant to sponsor (which grant will be confirmed in writing on request of sponsor, and the released parties the right and permission to print, publish, broadcast, and use, world wide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the participant’s entry, name, portrait, picture, voice, likeness, opinions and biographical information (including but not limited to hometown and state) for advertising, trade, and promotional purposes (including the announcement of their name on television or radio broadcast) without additional consideration, compensation, permission, or notification.

THERE IS A LIMIT OF THIRTY-THREE (33) TOTAL POSSIBLE ENTRIES PER PERSON FOR THIS PROMOTION. TEN (10) ENTRIES AT EACH OF THE THREE (3) PARTICIPATING DEALERSHIPS AND ONE (1) EXTRA ENTRY MADE ONLINE AT EACH OF THE THREE (3) PARTICIPATING DEALERSHIP’S WEBSITES. 4.    SELECTION OF WINNERS:
On Wednesday, September 3, 2026, Sponsor will select the name of the one (1) winner in a random drawing from the single combined pool of all eligible entries received from all participating locations, including all dealership kiosks and via online at the participating dealership’s website. The Winner will be drawn from among all eligible entries in the pool. A Winner may have registered at any participating location. The odds of winning depend on the total number of eligible entries received across all participating locations combined. We will attempt to notify the Winner by email and telephone, on Friday, September 4, 2026. We will continue to attempt to contact the Winner for seven (7) business days and will thoroughly document those notification attempts. If the Winner is still unable to be contacted and is unresponsive, then another winner will be drawn from the remaining pool of entries.
Except where legally prohibited, the Winner must schedule delivery of the prize, within seven (7) days of acknowledgement of the notification, and submit a Declaration of Eligibility and Publicity Release to claim their prize. If the Winner fails to sign and return the Declaration of Eligibility and Publicity Release or any other documentation that Sponsor may require, in its sole discretion, within the required time period (if applicable), if Winner fails to schedule delivery of the prize within the time period specified by Sponsor, or in the event that a Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate Winner selected by a random drawing from among all remaining eligible entries and subject to the same requirements set forth above. If Sponsor are unable to determine and verify a Winner after repeated alternate drawings, Sponsor reserves the right not to award the prize.
Verification of the Winners: THE WINNERS ARE SUBJECT TO VERIFICATION BY THE SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. PRIZE RESTRICTIONS: Winner will be responsible for payment of associated federal, state, and local taxes on the Verifiable Retail Value of the vehicle at the time of title transfer, plus DMV title, E-File, and license fees. Illinois winners may also be responsible for a 4.95% flat income tax on the Verifiable Retail Value of the vehicle. Sponsor will issue the Winner a 1099 tax form recording the receipt of their prize in the amount of the Verifiable Retail Value stated herein. Any and all fees and expenses related to acceptance and use of the prize not specifically stated herein, including but not limited to automobile insurance and any other costs associated with vehicle ownership, are the sole responsibility of the winner. Prizes do not include any transportation to and from the Dealership. The prize cannot be substituted, assigned, transferred, or redeemed for cash. The sponsor will not replace any lost or stolen prizes. No insurance is provided as part of the prizes, and obtaining insurance is the sole responsibility of the Winners. The prizes cannot be used in conjunction with any other promotion or offer. Only one prize stated in these Official Rules is available to be won in the Promotion. 6.    GENERAL CONDITIONS:
Participation constitutes Participant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Promotion Entities and their affiliates are not responsible for lost, late, or incomplete entries; technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise, the announcement of the prize or in any Promotion-related materials.

8.    DISPUTES:
Except where prohibited, participant agrees that: (1) all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State of Wisconsin court system located in Walworth County, Wisconsin, or the United States District Court for the Eastern District of Wisconsin (Milwaukee Division); (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion not to exceed fifty US Dollars (US$50.00), but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
